Val Verde County DWI Guide

Del Rio Police logged 39 DWI charges in 2024, the Val Verde County Sheriff's Office another 30, plus whatever the Texas Highway Patrol pulled off US-277 and US-90 — numbers that have held roughly steady since 48 charges in 2022. What makes Val Verde different from most Texas counties isn't the volume, it's the border.

Federal checkpoints on those same highways function as de facto screening points, since Texas bans fixed municipal sobriety checkpoints. Agents trained to spot intoxication routinely hold suspected impaired drivers until DPS or sheriff's deputies arrive to file the actual state charge. It's also common for a DWI to surface secondarily during a human-smuggling stop — DPS troopers chasing a smuggling case will often find impairment too, and the two charges stacked together drive bail sharply higher.

Vehicle recovery. Leo's Wrecker Service and Storage, at 3721 E Highway 90, runs 24/7 emergency dispatch but keeps its administrative release office to Monday through Friday, 9:00 AM to 5:00 PM. Arrested Friday night, and the earliest realistic pickup is Monday morning — budget for at least three days of storage on top of the tow fee. A secondary lot, Del Rio Towing & Wrecker on Highway 90 East, is also in rotation.

Jail and bail. This is the county's defining complication. The Val Verde County Detention Facility is a 1,407-bed facility run under contract by the GEO Group, housing county inmates alongside federal ICE and US Marshals detainees in the same building. If a records check during booking raises a residency-status flag, an ICE detainer (Form I-247A) gets lodged immediately — and posting a local county bond does nothing in that case; the person transfers straight into federal custody instead of walking out the door. Confirming the absence of a federal hold before anyone pays a non-refundable bondsman's premium is essential. The jail sits several miles outside Del Rio's commercial center on FM 2523, so a released defendant without a ride is genuinely stranded.

Court. Misdemeanor DWIs go to the County Court at Law, under Judge Sergio Gonzalez, who also runs the county's DWI/Drug Specialty Court — a program heavily subsidized by state grants, mandating SCRAM monitoring and ignition interlock devices for up to 70 participants a month. Felony charges split between the 63rd and 83rd District Courts.

License suspension. The standard 15-day ALR deadline applies, filed centrally with DPS in Austin rather than locally. One wrinkle worth knowing: if you submit to a blood draw instead of a breath test, the suspension notice doesn't go out until the lab processes the sample — sometimes weeks later — and the 15-day clock then runs from the mailing date of that later notice, not the arrest.

Scam warning. The Sheriff's Office has repeatedly warned about callers spoofing dispatch numbers and impersonating deputies, demanding wire payments or prepaid debit cards to "clear" fabricated warrants — a real risk specifically targeting people already navigating a genuine court case.
