Red River County DWI Guide

Red River County logged 19 DWI arrests in 2023, split almost evenly between the Sheriff's Office and Texas DPS troopers working US Highway 82 and State Highway 37. That's the entire enforcement picture for a county of about 12,000 people — no municipal task force, no standing checkpoints (Texas doesn't allow them), just deputies and troopers covering a lot of rural road.

Every arrest, regardless of which agency makes it, funnels into one building. The Red River County Jail in Clarksville is the sole intake point for the Sheriff's Office, the Clarksville Police Department, and DPS alike, so the booking process doesn't vary much by who pulled you over.

Vehicle recovery. Weemes Wrecker Service handles the tows, and the county has no backup lot — if your car isn't there, call the arresting agency's dispatch to confirm. Texas caps the fees: $272 for a standard tow, $22.85 a day for storage. A quirk worth knowing: if the vehicle sits on the lot across two calendar days but less than 12 hours total, the lot can only bill one day of storage. The lot won't release the car to anyone but the registered owner, even if the arrested driver was just borrowing it.

Jail and bail. Magistration happens within 24 to 48 hours, and once bond is posted, physical release can take as little as 90 minutes — though shift changes and weekend understaffing routinely push that out. Statewide first-offense bail averages $2,819; a second offense averages $5,139. A bail bondsman's premium is capped at 15% of the bond or $50, whichever is higher.

Court. Misdemeanor cases go to the Red River County Court; felony DWIs (third offense, intoxication assault, a child passenger in the car) move up to district court. The courthouse enforces a strict dress code — no shorts, tank tops, or logo clothing, shirts tucked in — and cell phones must stay silent, not just on vibrate. The county does run an Adult Felony Drug Court, though there's no dedicated misdemeanor DWI docket.

Pretrial diversion exists for first-time offenders with a clean record, a valid license, and steady employment, but it's not automatic. Accidents, CDL holders, gang affiliation, and high BAC readings (above 0.12-0.15%) disqualify an applicant outright. Accepted defendants face 6 to 18 months of supervision: IID installation, random urinalysis, community service, and substance abuse classes.

License suspension. You have 15 calendar days from the date your license is confiscated to request an ALR hearing contesting the suspension; miss it, and the suspension kicks in automatically on day 40. The nearest IID installer is Smart Start, located across the county line in Paris — but they run a mobile installation fleet, so a driveway install is often possible without the drive.

For substance abuse evaluation, the county is served by the OSAR Region 4 provider in Tyler. DWI education runs through the Alcohol and Drug Abuse Council of Deep East Texas, which charges $85 for the standard 12-hour first-offense course and $250 for the 32-hour repeat-offender program — paid strictly by cashier's check or money order, no cash.
