Hays County Vehicle Impound Guide

A vehicle with out-of-state plates gets a rare piece of leverage in Hays County. If the storage facility doesn't formally request the car's motor vehicle record from its home state within five days of taking custody, a common gap given how many out-of-state students drive through on I-35 to Texas State, the facility forfeits the right to charge any storage fee beyond that initial five-day window. Given the large out-of-state student population, this is worth checking on every non-Texas plate.

No central lot, just whoever was next in line

Hays County doesn't run its own impound yard. Deputies and municipal police dispatch tows through a rotation of private companies assigned by geographic sector, so the car ends up wherever the next company on the list happened to be. The company that responds has to do the tow itself under the county's Wrecker Service Agreement; it can't subcontract to a second company, so at least the car isn't hiding at some secondary lot. Call the arresting agency's non-emergency dispatch, for county arrests that's the Sheriff's Office at 512-393-7896, with the plate or VIN to find out which lot actually has it.

The 12-hour exception

Storage runs $22.85 a day, and a facility can legally bill for any part of a calendar day. But if the car is on the lot less than 12 hours total, even if that spans two calendar days, only one day can be charged. A car towed at 10 p.m. Friday and picked up at 8 a.m. Saturday is 10 hours on the lot and should be billed for one day, not two. Lots frequently get this wrong by defaulting to the midnight crossing, so check the timestamps against the bill.

If the owner is in jail

The person who was driving is often the registered owner, and if they're in custody, the lot will typically turn away anyone else trying to retrieve the car. Getting around that means either waiting for the owner's release or arranging a notarized power of attorney or the standard VSF release authorization form from inside the jail.

San Marcos-specific wrinkles

The city's 2024 ordinance amending its wrecker regulations expanded where private storage facilities can be located out into the extraterritorial jurisdiction, meaning a car towed inside city limits can now end up considerably farther out in the county, and it raised the maximum allowable fees for municipal tows at the same time. Separately, San Marcos will boot or fully impound any vehicle carrying three or more unpaid parking citations, so an existing hold on the car's registration can stack directly onto the DWI tow bill.
