How Bail Bonds Work

Option 1: Cash Bond (Pay Full Amount)

How it works: Pay the full bail amount to the court

Pros: Get full amount back after case concludes (minus court fees)

Cons: Requires full amount upfront

Option 2: Bail Bondsman (Most Common)

How it works: Pay 10-15% fee to bondsman, they post full bail

Cost: Typically 10% of bail amount (non-refundable)

Pros: Only need 10% upfront instead of full amount

Cons: Fee is non-refundable, may require collateral, co-signer assumes liability

Co-Signer Liability Warning

Important for Co-Signers:

  • You are 100% liable if defendant does not appear in court
  • You must pay the full bail amount if defendant skips
  • Bondsman can seize collateral (house, car, etc.)
  • You cannot cancel the bond - only the court can
  • Liability continues until case is fully resolved

After Release: Critical Deadlines

1. Request Administrative License Revocation (ALR) Hearing - 15 Days

You have only 15 days from arrest to request your administrative license hearing. This is separate from your criminal case.

2. Retrieve Your Vehicle

Impound fees accrue daily. Get your car as soon as possible to avoid hundreds in storage fees.

Most El Paso DWI arrests land at the Downtown Detention Facility, 601 E. Overland, where booking triggers a set of statutory fees before anyone even sees a judge: $10 for fingerprint processing, $6 for a local criminal history check, and a $20 case research fee. If the arrest happened without a valid ID in hand, often because the license was seized or left in the impounded car, identification has to run through fingerprint and criminal-history checks instead, which adds time.

Texas law requires a magistrate hearing without unnecessary delay, generally within 24 to 48 hours, and it happens right inside the Downtown facility. The magistrate reads the specific charge and sets bail using a published minimum schedule: $500 for a standard first-offense DWI, $750 if the BAC was over 0.15, $5,000 for a third or felony DWI, $1,500 for a DWI involving a child passenger, and $10,000 for intoxication assault. Those are floors, not ceilings. An accident, hostility toward officers, or a history of missed court dates lets the magistrate go higher.

Before that hearing, a Pretrial Services officer from the El Paso County Justice Services Department may interview the defendant to gauge flight risk and community ties. Giving accurate, verifiable details about local residency, employment, and family during that interview is the single biggest factor in getting a Personal Recognizance bond recommended, which lets someone walk out on a promise to appear plus a small administrative fee, usually around 3% of the bond amount, instead of posting the full sum.

Beyond a PR bond, there are two other paths. A cash bond means depositing the full bail amount with the Sheriff, refunded (minus small fees) once the case closes, but it ties up real money for months. A surety bond through a licensed bondsman costs a non-refundable 10% to 15% of the bail amount and usually requires a co-signer and collateral. Not every bondsman can legally write a bond here, either. The El Paso County Bail Bond Board maintains an active list, and the Sheriff will reject paperwork from a company that isn't on it, which just extends the wait. Bond offices physically close to the jail, clustered on Overland, Kansas, and Myrtle streets, tend to process faster simply because their agents can walk paperwork to the bond desk instead of driving it across town.

Posting bond doesn't mean immediate release. Out-processing, which includes a warrant check and returning property, typically runs 2 to 4 hours, and can stretch past 8 hours on a weekend, a holiday, or during a shift change. Shift changes themselves are a known dead zone, usually 6 to 7 in the morning and evening, when outgoing staff hand off custody logs and processing slows noticeably. A detainee walks out without a charged phone or a ride, so having family physically at the jail, or immediately reachable, matters more than it sounds like it should.
