Don't Face This Alone
A attorney can make the difference between a conviction and a dismissal, between jail time and probation. They know local judges, prosecutors, and can challenge evidence that you might not even know is challengeable.
Find San Juan County AttorneysThe San Juan County Sheriff’s Office (SJSO) faces unique challenges due to the county's rugged terrain and high altitude, operating at a mean elevation of 11,240 feet. DUI arrests often trigger a logistical chain extending to neighboring La Plata County and state offices in Denver.
DWI Court Procedures in San Juan County, Colorado
If you've been arrested for DUI in San Juan County, Colorado, it's important to understand the local court procedures. Due to the county's unique geography and limited infrastructure, the process involves some specific considerations.
Arrest and Vehicle Impoundment
Following a DUI arrest, your vehicle will likely be impounded. Animas Towing & Recovery is the primary towing vendor for the Town of Silverton and surrounding areas. You can reach them at (970) 946-4303. Keep in mind that Animas Towing is a "micro-fleet" operation; retrieving your vehicle outside of business hours might require direct negotiation with the operator.
During winter months, be aware of the Town of Silverton's Snow Route Ordinance. If your vehicle is left parked on a public street overnight during a "Red Alert" snow event, it will be towed for a snow removal violation, adding to your impound fees. During a Red Alert, parking is prohibited on Greene Street (the main commercial drag) from Midnight to 8:00 AM. The town will send out alerts to those who text 81433 to 888-777.
To retrieve your vehicle from Animas Towing, you'll need a valid driver’s license (or a licensed driver), proof of ownership (registration or title), and proof of insurance. If the vehicle is under a "Police Hold" due to an ongoing investigation, you'll need written authorization from the SJSO before the tow yard will release it.
Detention and Processing (The La Plata Transfer)
San Juan County does not have its own jail. If arrested, you will be transported approximately 48 miles south to the La Plata County Detention Center in Durango. This process, known as the "La Plata Transfer," can take over an hour, especially during winter conditions.
Upon arrival at the La Plata County Jail, you'll be processed and potentially held until bond is posted. The 6th Judicial District sets standard bond amounts for DUI arrests. You can post bond via the TouchPay kiosk in the jail lobby (Facility ID: 781303), online at touchpayonline.com, or in person with cash. Be sure to have the inmate's ID number, which can be found on VINELink (vinelink.com). Several bail bondsmen operate in the 6th Judicial District, including Dennis Blackwell Bail Bonds and ASAP Bail Bonds.
A significant challenge upon release is the "Silverton Stranding." Being released in Durango, 50 miles from your vehicle impounded in Silverton, can leave you without transportation. Rideshare options are unreliable. Buck Horn Limousine offers transport to Silverton, but rates start around $252.00 and require a reservation.
The Court Process (San Juan County Combined Courts)
Your case will be heard in the San Juan County Combined Court, which is part of the 6th Judicial District. County Court Judge Hon. Anthony Edwards presides over misdemeanor DUI cases. For Felony DUIs, jurisdiction moves to the District Court, with Judge Anthony Nathaniel Baca and Chief Judge Jeffrey R. Wilson potentially involved.
The San Juan County Courthouse is closed on Wednesdays and Fridays. The 6th Judicial District enforces strict rules regarding electronics in the courthouse, with cell phones permitted but required to be silenced.
To retrieve your vehicle from Animas Towing, you can reach them at (970) 946-4303.
